The Death Penalty, Right or Wrong? Fear of death discourages people from committing crimes. If capital punishment were carried out more it would prove to be the crime preventative it was partly intended to be. Most criminals would think twice before committing murder if they knew their own lives were at stake. As it turns out though very few people are executed and so the death penalty is not a satisfactory deterrent. Use of the death penalty as intended by law could actually reduce the number of violent murders by eliminating some of the repeat offenders. More timely enforcement of the death penalty would help to reduce the crime problem by instilling a sense of respect for the law in that sentences are more than words on a page.   Ã‚  Ã‚  Ã‚  Ã‚  The death penalty has always been and continues to be a very controversial issue. People on both sides of the issue argue endlessly to gain further support for their movements. While opponents of capital punishment are quick to point out that the United States remains one of the few Western countries that continue to support the death penalty. The deterrent effect of any punishment depends on how quickly the punishment is applied.   Ã‚  Ã‚  Ã‚  Ã‚  Is making the prisoner suffer by being in jail for the rest of his life is more torturous and inhumane than execution? Let us look at some of the methods of execution used in the past. Through the centuries people have been stoned to death, boiled in oil, skinned alive, crucified, roasted over fires on iron beds, pulled apart with horses, had their heads cut off, been hanged, been drawn and quartered, sawn in half, and broken with a wheel. (Hickman, 2003, p. 174) Hanging was the most widely used form of execution in the United States until the middle of the twentieth century. Negotiation in Action One of my most substantial accomplishments is that I learned significant concepts and principles of negotiation during the course. Negotiation process and a variety of tactics that I learned in class or through the textbook, Getting to Yes, were definitely helpful for improving my understanding of negotiation and its strategy. Another important accomplishment is that I have learned what I couldn’t have learned from lectures or textbooks through negotiation simulations.I prepared a lot for each negotiation and tried to follow the strategy that I had set up in advance. After negotiations, I tried to identify what worked, what didn’t and how I could improve next time. I have kept a list of successes and mistakes and I have eventually become more confident in a variety of negotiation situations. While negotiating, I have been more like a soft positional negotiator who emphasizes the importance of building and maintaining a better relationship, trying n ot to hurt other’s feelings.My unique set of negotiation skills are : ? polite, positive and active attitude, ? a good listener and ? thinking of the other’s position. During the process of negotiation simulations, I have always tried to listen more actively and acknowledge more carefully what is being said by the partner. If I pay attention more, the partner will also feel the satisfaction of being heard and understood. However, I realized that I need to balance my position better according to different situations.I have learned that constructively initiating positional bargaining is essential and approaching to solutions according to my position is more effective in negotiation process. In addition, I have learned not only that negotiating with partners cooperatively and competitively is one of the most significant factors for successful negotiation but that cultivating good relationships for the future is very important as well. To do so, I need to effectively manag e emotions in disputes and favorably understand cultural differences.I would like to set two top priority goals for my future negotiation. One is that, thinking about a variety of tactics such as â€Å"BATNA†, ZOPA, and etc. , I will always try to find an optimal solution, which is â€Å"win-win† for both sides, instead of arguing over my position and pursuing only my own interests. The other priority is that I will establish healthy personal and professional relationships in my life, having a positive and active attitude, understanding people, appreciating their wants, identifying their needs and learning about their background and what makes them who they are.Recommendation Letter I strongly recommend this course. This course is designed to cover the range of negotiation situations and issues faced by managers and decision makers. This course explores negotiations in many contexts: simple personal transactions, public and private sector collective bargaining, resolvi ng disputes. First, the original play's impressions are quite different from the film versions in the reading. A reader is left only to the benefit of her own imagination while reading a play. It seems actually more like listening to an old fashioned radio show because it is mostly dialogue. But there aren't even tones of voice with which we interpret so much conversation. There are no rehearsed or measured pauses which create a very frenetic impression of many of the characters – especially Nora. Nora comes across as a top spinni ng out of control. Her husband reads as disinterested, his affections just that, affected. Christine is not anchored into the plot as well as she is in film. Strangely, Grogstad seems even more threatening on paper than on film. My conclusion, as one not accustomed to plays or theatre is that a script is the original physical reality of a play but that it takes the winds of theatrical talent to breathe life into it. The characters seem one-dimensional. The author may have his intentions but the soul of each performance and the spirit in which it speaks its truths to the audience varies. I chose the above attributes for my character because India at the time was characterized by great religious devotion and social discrimination. Because of this the mentally ill prison population, by and large, continues to be untreated and this has severe implications for society. Discussion Unfortunately, humanitarian concerns do not dominate the penal system in England andWales, but, rather, the dominant concern is that the perceptions and attribution of risk are attenuated (Peay, 2007, p. 497). Because of the perception and risk attribution of these offenders, therapeutic considerations are considerations no longer. This in contrast to the recommendations of the Home Office Circular 66/90, which stated that mentally disordered offenders should be placed in the care of health and personal services, a ccording to their mental illness. This recommendation would have caused the prisons to adopt a treatment-based approach, with a de-emphasis on the questions of risk and reoffending, and would have taken mental health law in the direction of medical law (Peay, 2007, p. 498). This approach was rejected by the Government, which, in its White Paper (Department of Health/Home Office 2000), put the safety of the public as the paramount concern, not treating the mentally ill offender, and called for, in essence, â€Å"a form of indefinite detention for some people with personality disorder† (Peay, 2007, p. 498). Therefore, this pushed mental health law more in the direction of penal law, and away from the direction of medical law (Peay, 2007, p. 498). There are a number of different schemes through which a mentally disordered criminal can get treatment instead of straight incarceration. One of these schemes is court diversion (Peay, 2007, p. 506).
